Alias(es): TERMS OF USE, TERMS AND CONDITIONS

1. GENERAL TERMS

​​The following Terms of Service ("TOS") are between the User and PLUSHY and contains an agreement that governs the use of the sound source library (referred to as "voicebank") for the UTAU program. "PLUSHY" is defined as the author of the sound source library. The User must read the TOS and agree to it before downloading or purchasing the sound source library. Avoid using the voicebank if you do not understand the TOS.

PLUSHY may change or upadate the TOS at any point of time and is not liable for the User's non-compliance to the updated version of the TOS.  By accepting these TOS you agree and represent that you understand and agree to the foregoing and to what is stated below.

2. CONDUCT OF USER

​

The User agrees NOT to:

​

Publish any Content that is unlawful, harassing, threatening, harmful, tortuous, defamatory, libellous, abusive, violent, obscene, vulgar, invasive of another’s privacy, hateful, sexist, racially or ethnically offensive or otherwise discriminatory towards a party;

​

engage in any copyright infringement or other intellectual property infringement;

​

engage in any illegal, unlawful or any activity that would put the program, voicebank or PLUSHY highly susceptible to lawsuits or legal action;

​

use the voicebank an intent to hurt or harass another person.

 

3. PAYMENT

 

PLUSHY denies all liability for any loss or failure of payment from the User. Only when the full amount is paid, the voicebank is available to the User. The User is said to be given a non-transferable, non-exclusive license solely for personal use. 

 

Any use in excess of that granted by the licence, in particular the re-licensing of the file, rendering it available in Internet or any file-sharing network or any other commercial use of the file is impermissible and license of the user will be terminated. PLUSHY will not be liable for any temporary or permanent fault in the transfer of the data to the User’s server.

 

No refund will be given when the voicebank is deleted from the User's system.

4. USE OF VOICEBANK

​

The voicebank, paid in full consists of all required phonemes to operate in the UTAU program and is fully functional. The User can edit, modify or delete the voicebank solely for personal use, and shall NOT redistribute, re-sell or circulate the it in any form, edited or intact. The User can use the voicebank to act as character voice for a TV, anime or self-animated video when product is paid in full.
